Probate is a court proceeding through which the heirs (individuals entitled to inheritance under the applicable law by their blood or familial relationship to the decedent in absence of a will) or legatees (individuals entitled to inheritance under a will of the decedent) are verified and the distribution of assets of the estate to the heirs or legatees is approved by the probate court. Although we do represent clients in probate matters in Cook County, we view avoidance of probate as one of the most important aspect of any probate practice. Probate is a lengthy, expensive and usually unnecessary process, which in most cases can be easily avoided with even most rudimentary estate planning. Probate may be sometimes avoided even if no estate planning was done prior the decedent’s death.
